Revert "Merge branch 'revert-19211f3d' into 'master'" [RUN AS-IF-FOSS]

What does this MR do?

Original code was introduced with !43256 (merged) which was breaking FOSS build due to misplaced specs.

[RUN AS-IF-FOSS] is set to run the specs for FOSS to run FOSS jobs as well.

This MR brings back the reverted change and move EE tests into EE spec.
