Cannot select menu bar after opening new terminal window with "Exclude from Dock" enabled

Detailed steps to reproduce the problem:
- Open iterm2
- Navigate to Preferences > Appearance > General and enable the setting "Exclude from Dock..."
- Enable the sub-setting "...but only if all windows are hotkey windows"
- Close the preferences window and all terminals
- Click on the status bar icon for iterm and click "Preferences"
- Once in the preferences menu, use the ⌘ + N keyboard shortcut to open a new terminal window
- Try to click on menu bar items, like "Shell" or "Edit"
What happened: Menu bar items are not responsive
What should have happened: Menu bar items should be responsive
Description: I was messing around with the hotkey settings to create a drop-down always-on terminal session and discovered the appearance setting to remove iterm from the dock, which seemed perfect. It would essentially put the terminal in a hidden state and I really couldn't get to it without intending to. After enabling this, I was thinking "Alright, so if I need a new terminal window for some reason to stick around, I'll just open the preferences window and use the keyboard shortcut to make a new terminal". And when I did, I noticed that the menu bar items weren't responding to user input. They did eventually if I switched to another app/Finder for focus, and then back to iterm.
Is this intended behavior?
