WIP: Fix test so they can pass on 1 second resolustion mtimes

Description

This still has the odd issue with the remote expirey test witch confuses me

Also the fix for trying to build a element that should fail as the hole stack dose not fit in the cache seems like it might be hiding a real bug

So I am not sure if we want to merge it but if we keep having issues with the CI it might be good enough for now so long as we create issues for the problems

A WIP:MR seemed like a good place to record the discussion.
