apply-patch fail -> can not apply another patch

Applying a patch which fails (eg. because the dependencies did not match
(eg. second patch, without first one is added)),
the .git/rebase-apply folder will stay in place,
which will result in not being able to add another patch with the error message
"previous rebase directory .git/rebase-apply still exists but mbox given."

git version 1.6.4.msysgit.0
on win7 x64
