pcbnew DRC: erroneous error? `items shorting two nets (nets and )`

Description

DRC's reporting 2 NPTH shorting unnamed nets

i have exactly the same footprint on the other corner of my board
and it's not finding an error there (maybe zone related?)

Steps to reproduce

1. in this project, https://gitlab.com/evils/waad/-/tree/58cb142d1c43f69b080032bba8545dcf6d5e58cb/pcb
2. run DRC
3. see the error in the screenshot above
