Resolve Plan.free use of gitlab com check

  changing this causes us to fall through to ::Plan.free below, which right now is still using Gitlab.com?...so this causes us, for right now, to add :saas metadata tag on a few more specs and to also fix logic in a few specs that was a bit off.
