Unable to accuire items requiring nation to be in 1st or 2nd even when tied second

Tried buying rank6 R.K Chainmail and Breeches from San d'Oria guard after getting rank6, but was unable to get the items eventho they showed up in the list, and should be available since San d'Oria is currently tied in second place.
