NPCs don't report crime if the player is casting offensive spells on them while sneaking

In Morrowind, NPCs such as Dralasa Nithryon will report crime if you cast Paralysis on her while sneaking (Player character has 100 sneak).

In OpenMW she doesn't report crime when the player is sneaking, but she will report it if the player character wasn't sneaking.
